Dear Mr. Coburn: YOUR PROCEDURAL REQUEST FOR PHASE 8, BAY-DELTA WATER RIGHTS HEARING Thank you for your July 19, 1999, letter to Chairman Stubchaer in which you request that the major pre-1914 appropriative water right holders and the in-Delta riparian water right holders be added to the parties whose water rights will be reviewed in Phase 8 of the Bay-Delta Water Rights Hearing. Since receiving your letter, Mr. Stubchaer has received several letters from other parties regarding your request. Any decision at this time regarding the scope of Phase 8 would be premature. We expect that the outcome of the completed phases of the hearing will substantially affect the scope of Phase 8. Accordingly, the SWRCB will not consider any action regarding the scope of Phase 8 in the immediate future. The SWRCB will notify the parties when it releases a draft decision that addresses the completed phases of the hearing. I expect that a draft decision will be released later this fall.
