Participants, Bay-Delta Water Right Hearing

ISSUES REGARDING DUE DATES FOR CLOSING BRIEFS AND THE BAY-DELTA SERVICE LIST

1.   On April 20, 1999, the State Water Resources Control Board (SWRCB) received a request from Daniel J. McCarthy that he be added to the Bay-Delta Service List as a participant.  He will be allowed to participate only to the extent that he follows the procedures in the Phase 2B Supplemental Notice of Public Hearing.

2.   In response to an oral motion presented by the California Department of Water Resources during the hearing on April 20, 1999, the SWRCB has extended the due date for Phase 6 closing briefs until May 17, 1999 at 5:00 p.m..

3.   On April 21, 1999, on behalf of the San Joaquin River Group Authority, Mr. Tim O’Laughlin submitted a written request to Chairman Stubchaer for a second extension of time to file briefs for Phase 2A of the hearing.  Mr. O’Laughlin requests that Phase 2A briefs not be due until some time after the completion of Phase 2B.  This could result in an extension until late July or early August.  Mr. O’Laughlin cites preparation for Phase 2B, the dates for filing briefs on other phases of the hearing, and the relationship among Phases 2, 2A, and 2B as a basis for the requested extension.  The current due date for Phase 2A briefs, after one extension, is May 3, 1999, at 5:00 p.m.

Mr. Stubchaer has denied the requested extension.  Although there is a relationship between Phases 2A and 2B, the SWRCB nevertheless believes that the issues in the two phases are separable and that receiving the Phase 2A briefs on May 3 as scheduled will facilitate its timely analysis of the hearing record.  Accordingly, the Phase 2A briefs will remain due on May 3.
