Enclosed is a draft stay order for Phase 8 of the Bay-Delta Water Rights Hearing. It responds to a draft Agreement Regarding Resolution of Phase 8 Issues, Development and Management of Water Supplies, and a Binding Commitment to Proceed Pursuant to Specified Terms (draft Agreement). I am circulating this draft order to the parties on the Bay-Delta Water Rights Hearing service list for a preliminary review before the State Water Resources Control Board (SWRCB) schedules it for consideration at a Board meeting in either March or April. This circulation accommodates the request by the parties negotiating the draft Agreement to see the draft response of the SWRCB at the earliest opportunity. Any party may comment on this draft order and may request changes. I request that any comments be submitted to the SWRCB, attention of Nick Wilcox, Chief, Bay-Delta Unit, Division of Water Rights, on or before 4:00 pm on February 28, 2001.
Copies of all comments submitted to the SWRCB must be served on all of the parties on the attached service list.
