BAY-DELTA WATER RIGHTS HEARING: RULING ON REQUEST FOR SPECIAL SESSION ON CARRIAGE WATER
Thank you for your letter dated June 1, 2000. You request, on behalf of the Department of Water Resources (DWR), that the State Water Resources Control Board (SWRCB) conduct a special session during
Phase 8 of the Bay-Delta Water Rights Hearing to address the carriage water issue set forth in the current notice of hearing dated April 19, 2000. You request that a special session on carriage
water be held no earlier than mid-December 2000.
The SWRCB currently expects to conclude its receipt of evidence in Phase 8 by the end of October, 2000.
Further, the carriage water issue is integral to the other issues in Phase 8 and should not be separated. Therefore, the SWRCB will not, at this time, separate out the carriage water issue; nor will it give notice of a special session late in December 2000. The DWR is not precluded from submitting a future request for permission to present late case-in-chief evidence on carriage water, but I cannot determine at this time whether the request will be granted.
To ensure that they can present all their evidence on the carriage water issue, the parties must submit all relevant Phase 8 evidence currently available to them by the June 30, 2000 deadline, including
evidence on the carriage water issue. During the hearing, if the a party believes that additional direct evidence would be helpful on the carriage water issue, a party can request the opportunity
to present additional evidence. Please note that new evidence also can be presented on rebuttal, to respond to adverse evidence in the hearing record presented by other parties.
