At the meeting, at their October 17, 2002 Board Meeting,
the SWRCB adopted a final order extending the dismissal date for Phase 8 until
January 31, 2003. The Department of Water Resources and the
United States Bureau of Reclamation submitted letters to the
SWRCB requesting the extension. The SWRCB also received an
update from parties who are negotiating their responsibilities
for meeting Bay-Delta water quality objectives.

Today the SWRCB adopted Order WR 2001-05. This order stays the resumption of Phase 8 of the Bay-Delta Water Rights Hearing for
eighteen months. The order automatically dismisses Phase 8 at the end of eighteen months, unless the SWRCB receives notice from the Department of Water Resources (DWR) or the United States
Bureau of Reclamation (USBR), within eighteen months, requesting resumption of Phase 8.

Today the SWRCB sent to the Bay-Delta Service List another revised draft
order regarding stay and dismissal of Phase 8 (PDF format; 36 KB) of the Bay-Delta Water Rights Hearing. This draft is based on comments received at the April 4 Board meeting. Unlike previous drafts, the proposed order is based on an independent commitment of the Department of Water Resources and the U.S. Bureau of Reclamation to meet the objectives in the 1995 Bay-Delta Plan for an interim period and to accept indefinite extensions of Conditions 1 and 2 in Decision 1641. The proposed order stays Phase 8 for a period of eighteen months, and automatically dismisses Phase 8 at the end of eighteen months, unless
the SWRCB receives a request from the Projects to resume Phase 8.
The draft order will be considered for adoption at the April 26, 2001, Board meeting at 1 PM. Written comments should be sent to Harry Schueller, Chief, Division of Water Rights, no later than
4 PM, Friday, April 20.

Today the SWRCB mailed to the Bay-Delta Service List a revised Draft Stay Order for Phase 8 (PDF
format; 57 KB). The revisions are based on written and oral comments received at the March 7 Board meeting and subsequent discussion at the March 21 closed Board meeting. The
Board will consider adopting the draft order at a meeting to be held on April 4 at 1:00 PM. Written comments should be sent to Harry Schueller, Chief Division of Water Rights, by 5:00 P.M.,
March 30. Copies should also be sent to the Service List. Parties will have a brief opportunity to comment at the meeting on the general
acceptability of the order and to propose possible technical corrections.
The Board will also consider on that date a draft Resolution finding that the project titled "Planning Investigation for Implementation of the Phase 8 Settlement Agreement" is consistent with the Bay-Delta Water Quality Control Plan and the Safe, Clean, Reliable, Water Supply Act (Proposition 204).

Today the SWRCB sent out a Draft Stay Order for Phase 8. It responds to a draft “Agreement Regarding Resolution of Phase 8 Issues, Development
and Management of Water Supplies, and a Binding Commitment to Proceed Pursuant to Specified Terms” (draft Agreement). Bay Delta Water Right Hearing participants and other interested parties are
requested to provide their comments regarding the Draft Stay Order to the SWRCB by 5 p.m. on Monday, March 5, 2001. Copies should also be sent to the Service List. A meeting to consider adopting the draft Order is scheduled for Wednesday, March 7, 2001, at 9:00 am in the 2nd Floor, Coastal
Valley Room in the new Cal/EPA Building at 1001 I Street in Sacramento.

Today the SWRCB sent out a Notice of Public Workshop for Phase 8. Bay Delta Water Right Hearing participants and other interested parties are
requested to provide to the SWRCB by 4 p.m. on Friday, January 5, 2001, 20 hard copies of their written comments on two subjects: (1) the schedule for resumption of Phase 8 of the Bay-Delta Water
Rights Hearing, and (2) the status of negotiations between export and upstream interests. Copies should also be sent to the Service List.

The SWRCB announced a postponement of the commencement of Phase 8 of the Bay-Delta Water Rights Hearing. Deadlines for submitting exhibits and legal briefs were also postponed.
The hearing will not commence until early 2001. The postponement was requested by the Department of Water Resources and the U.S. Bureau of Reclamation. Click here to see Notice of Postponement of Hearing

The SWRCB adopted a decision addressing water protection objectives for the San Francisco Bay/Sacramento-San Joaquin Delta Estuary. D-1641 is the result of a public hearing conducted by the
Board that began July 1, 1998.
The remaining phase of the hearing to consider the responsibility of Sacramento River Basin water right holders in meeting objectives of the Board’s 1995 Delta Water Quality Control Plan is scheduled to begin in spring of 2001.
